Public Records Request

Public Records Access

Under California Government Code Section 6253, every person has the right to inspect public records, except those exempt from disclosure by law.

A public record includes any writing containing information related to the conduct of District business that is prepared, owned, used, or retained by the District, regardless of format. This may include printed documents, emails, photographs, recordings, or other forms of recorded communication.

Policy

Records of the Rubidoux Community Services District are available for inspection during normal office hours at:

3590 Rubidoux Blvd, Rubidoux, CA

Any person may inspect District records except those specifically exempt from public disclosure.

Requesting Records

Requests to inspect or copy District records (other than routine billing or account information) must be submitted to District staff.

  • Staff will assist requesters in identifying responsive records when possible.
  • Records available electronically may be provided in electronic format when feasible and when doing so does not compromise system security.
  • Requesters may be responsible for costs associated with producing records, including copying or specialized data compilation.

Individuals requesting records will be provided with a Public Records Request form, and staff can assist with completing it.

Once a request is received, the District may:

  • Specify when and where records may be reviewed
  • Supervise record inspection
  • Provide copies after applicable fees are paid

Temporary Delays

Access to records may be temporarily delayed if:

  • Records are in use by District staff
  • Others are currently reviewing them
  • Records must be retrieved from storage
  • Staff required to supervise inspection are unavailable
  • Legal review is required to determine if the record is exempt

Fees

Fees may apply for copies or certified records and are based on the District’s actual cost of producing the records or any statutory fee required by law.

Records Not Available for Public Inspection

Certain records are exempt from disclosure under law, including but not limited to:

  • Drafts, notes, or internal memoranda not retained in the normal course of business
  • Records related to pending litigation or claims
  • Personnel, medical, or private personal information
  • Confidential business information or trade secrets
  • Examination materials (test questions, scoring keys, etc.)
  • Real estate appraisals and contract evaluations prior to completion of negotiations
  • Attorney-client privileged communications
  • Customer utility account records (except to authorized parties)
  • Vulnerability assessments and security-related documents
  • Records otherwise exempt under state or federal law

The District may also withhold records when the public interest in nondisclosure clearly outweighs the public interest in disclosure.
